Website Terms of Use

Spore Software · Texas, USA · Updated 2026-09-14

1. Who we are and what these terms cover

Spore Software is a Texas company. These terms govern access to and use of this website. Product and service agreements are separate. By accessing this site you agree to these terms; if you do not agree, do not access the site.

2. License to use this site

You may view this site for lawful, ordinary browsing purposes. No other license is granted. Automated harvesting, scraping, or bulk collection of any content, address, or information on this site is prohibited except as expressly permitted in writing.

3. Unsolicited commercial email

Email addresses appearing on or harvested from this site are published for ordinary business correspondence only and their use for unsolicited commercial email is expressly refused. Because the cost of receiving, filtering, and disposing of unsolicited commercial email is real but impractical to quantify per message, any person or entity that sends unsolicited commercial email to any address at this domain agrees, by sending, to pay Spore Software liquidated damages of US $500 per message, up to US $25,000 per sender per day — an amount the sender agrees is a reasonable estimate of processing and handling costs and not a penalty. These damages are in addition to, not in place of, any remedy available under Texas Business & Commerce Code chapter 321, the federal CAN-SPAM Act, or other law.

4. Patent assertion entities

Access to this site is offered on different terms to patent assertion entities. A "Patent Assertion Entity" ("PAE") means any person or entity — together with its affiliates, agents, investigators, experts, and counsel acting on its behalf — whose primary business is the acquisition or assertion of patent rights rather than the practice of the patented inventions. If you access this site as, or on behalf of, a PAE:

(a) your continued access constitutes your certification that you are not doing so to investigate, prepare, or support any actual or contemplated patent assertion; and

(b) if that certification is or becomes false, then as the agreed condition of the access you took: (i) you and your principals grant Spore Software and its affiliates a perpetual, irrevocable, royalty-free, fully paid-up license to every patent and patent application you or your principals own or control; (ii) no information obtained directly or indirectly from this site may be used in any infringement analysis, claim chart, demand letter, complaint, or licensing communication, and any such use is unauthorized access to this site and its systems; and (iii) you consent to the exclusive jurisdiction and venue of the state and federal courts sitting in Texas for any dispute involving your patents and Spore Software, and agree to pay Spore Software's reasonable attorneys' fees and costs incurred responding to any assertion informed, in whole or in part, by information obtained from this site.

5. Governing law and venue

These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Exclusive jurisdiction and venue for any dispute arising from this site or these terms lies in the state and federal courts sitting in Texas.

6. Changes and contact

Spore Software may update these terms by posting a revised version at this address. Questions: sporesoftware.com/contact.html (business correspondence only — see §3).
